§ 30.17. LAW ENFORCEMENT INVESTIGATION AID FUND.

  • (A) There is hereby established a special nonreverting fund to be known as the Law Enforcement Investigation Aid Fund, and whenever the Chief of Police for the City of Greenfield, Indiana, and or his or her designees seize funds under I.C. 34-24-1-1 or 21 U.S.C. § 881, the proceeds shall be immediately turned over to the Clerk-Treasurer for deposit into the Law Enforcement Investigation Aid Fund.
    (B) Disposition of proceeds derived from forfeited property pursuant to I.C. 34-24-1-5 shall be deposited into the nonreverting Law Enforcement Investigation Aid Fund hereby created as a subsidiary fund of the General Fund of the city, to be distributed pursuant to court order as may be issued in each forfeiture action, and as substantiated by a duly authorized claim issued and executed by, or on behalf of, the Chief of Police of the City of Greenfield, Indiana, with any excess funds to be transferred to the Treasurer of the State of Indiana for deposit in the commons school fund.
    (C) In accordance with I.C. 34-24-1-9, proceeds forfeited under 18 U.S.C. § 981(e), 19 U.S.C. § 1616a, or 21 U.S.C. § 881(e) and any related regulations adopted by the United States Department of Justice shall be deposited into the nonreverting fund known as the Law Enforcement Investigation Aid Fund.
    (D) Proceeds deposited into the fund known as the Law Enforcement Investigation Aid Fund may only be expended for any purpose associated with the investigation and/or prosecution of criminal activity or offenses associated with controlled substances within Hancock County, Indiana, or the reimbursement of said expenses to involved agencies pursuant to court order, upon approval of a duly executed claim by the Chief of Police of the City of Greenfield, Indiana, approved by the Greenfield Board of Works and Public Safety and for any other purpose consistent with federal law and regulation.
